Shabana Farhaana Amirudin is a partner at Cecil Abraham & Partners. She specialises in Construction & Infrastructure Disputes, Commercial and Corporate Litigation, Commercial Arbitration, Adjudications and Fraud Litigation as well as in Asset Tracing and Recovery. She has significant advocacy experience before the High Court and the appellate courts as well as before arbitral tribunals.

She has extensive appearance in appearing as counsel in adjudications and in institutional arbitrations under the rules of the AIAC, ICC, SIAC and DIAC to name but a few. She acts for a number of Malaysia’s leading developers and constructions companies in construction and infrastructure related disputes. She also has significant expertise in registering, enforcing and recovering assets in so far as high value foreign arbitral awards and judgments are concerned both onshore and offshore in Malaysia.

EXPERIENCE
  • Acted as Counsel for the main contractor in respect of an arbitration dispute involving fraudulent progress claims, interim certificates and termination with the architect and employer.
  • Acted as Counsel for the main contractor involving an arbitration dispute with the nominated sub-contractor for a residential building.
  • Acted as Counsel for the developer involving an arbitration dispute with the main contractor in respect of defective works amounting to RM10 million and liquidated damages.
  • Acted as Counsel in an arbitration involving the construction of a glove manufacturing factory in Klang where the dispute involves breach of contract with the claim and counterclaim being in the region of RM100 million.
  • Acted as Counsel in an arbitration dispute for the main contractor involving the construction of a glove manufacturing factory in Pahang where the disputes involve in amongst others, progress claims and quantum meruit in the region of RM16 million.
  • Acted as Counsel in an arbitration dispute for the developer of a mixed development against an engineer for breach of contract, negligence, and defects in the region of RM37 million.
  • Acted as Counsel for an interior designer against the contractor for construction disputes involving various projects in TRX Mall and Pavilion Damansara Heights Mall.
  • Acted for the main contractor in an adjudication commenced by the sub-contractor for a sum of RM10 million involving, amongst others, progress claims, variation orders and  loss and expense claims in respect of the construction of a highway project.
